SB 62 – Sponsored by Senator Marshall. Introduced on 3/24/05. An act to amend Title 19 of the Delaware Code relating to the minimum wage. This act would increase the minimum wage from $6.15/hr to $6.65/hr effective January 1, 2006 and from $6.65/hr to $7.15/hr effective January 1, 2007. Signed by the Governor on 6/28/2006. This bill was not endorsed by the Chamber.
SB 108 – Sponsored by Senator Cook. Introduced on 5/4/05. An act to amend Title 30 of the Delaware Code relating to certain business license fees. This bill will reduce the cost of certain occupational and business licenses for certain persons 65 years of age or older whose gross receipts from such licensed occupation or business are less than $10,000 per year. SB 136 – Sponsored by Senator Simpson. Introduced on 6/28/095.. An act to amend Title 4 of the Delaware Code relating to farm wineries. This act allows farm wineries to sell their wine for on-premises consumption and to use part of the winery for catering purposes. Signed by the Governor on 6/28/05. HB 152 – Sponsored by Representative Miro. Introduced on 4/27/05. An act to amend Title 6 of the Delaware Code relating to dishonored checks, drafts or orders. This legislation substantially reenacts the civil bad check statute (formerly 6 Del. C. § 3-806) which was repealed in 1995, and sets damages at $50.00 for the first bad check, draft, or order for the payment of money by a drawer to the plaintiff within 1 year. Damages are set at triple the amount of the bad check, draft or order for the second or subsequent bad check, draft, or money order within 1 year to exceed $250.00. It further specifies that the fee for a dishonored check prior to commencement of an action shall be $40.00. It expressly provides that damages or fees may not be obtained under this Act in any action for repayment of a short-term consumer loan, also known as a pay-day loan, made by a bank and subject to 5 Del. C. § 978 or made by a licensed lender and subject to 5 Del. C. § 2235A. Signed by Governor on 7/12/05. This bill was endorsed by the Chamber.
SB 175 – Sponsored by Senator Adams. Introduced on 6/14/05. An act to amend Title 26 of the Delaware Code relating to rate base. The existing definition of rate base predates the imposition of the Alternative Minimum Tax (AMT) on corporations. The payment of the AMT results in an adjustment to accumulated deferred income taxes. This legislation clarifies that this adjustment to accumulated deferred income taxes is recognized in determining the utility’s base rate. Signed by the Governor on 6/28/05. This bill establishes a civil recovery act for shoplifted materials from the individual caught shoplifting without need for filing criminal actions against the defendant. HB 303 – Sponsored by Representative Hudson. Introduced on 6/29/05. An act relating to the gross receipts and tobacco product taxes. This act reduces General Fund business and occupation gross receipts tax rates by 20 percent for all categories of taxpayers except automobile manufacturers, for which rates are reduced 25 percent. Further, the Act increases the monthly exemption amount by $30,000 for all categories except manufacturing. Signed by the Governor on 7/19/05. This bill was endorsed by the Chamber.
SB 343 – Sponsored by Senator DeLuca. Introduced on 6/6/06. An act to amend Title 5 of the Delaware Code and Volumes 70 and 72 of the laws of the State of Delaware relating to the Bank Franchise Tax. This Act extends the employment tax credit program under the bank franchise tax for an additional 5-year period. Under current law, the employment tax credit program expires at the end of the calendar year 2006. The reauthorization achieved by this Act continues the policy encouraging job creation and economic investment in Delaware. Signed by the Governor on 6/30/06. This bill was endorsed by the Chamber.
